General Terms and Conditions

For the purposes of these Terms and Conditions, « CL» means C.Russell trading as CHALET LOUISA - SIREN 427 508 601 of La Ferme du Pont Nalien, 434 Rue L’Essert, Les Houches, Vallée de Chamonix-Mt.Blanc, 74310, France.

Agreement

The terms and conditions which are printed on this website form the basis of the agreement between you (the Client) and Chalet Louisa (CL) for the holiday rental of the Property named in the Invoice/Confirmation (« the Property).

A contract shall be deemed to exist between the Client (and all other persons on behalf of whom the booking is made) and CL when, subsequent to the Client and CL confirming holiday details by telephone/email, the Client has made payment to CL of deposits/full payment and has received written confirmation from CL of receipt of deposits/full payment thus acceptance of the booking.

By making any payment of deposits/ holiday payment the Client shall be deemed to have read all the Terms and Conditions herein and agreed to be bound by them. By making a reservation the Client agrees that he is over 18 years of age and that he accepts full responsibility for all payments due and for the consequences of any actions of all persons who will use the Property during the Client’s Holiday/rental period.

Written communication will generally be emailed (Quotes/Invoices/Confirmation of Booking etc) but can be faxed or/and posted if requested. Our postal address is La Ferme du Pont Nalien, 434 Rue L’Essert, Les Houches, Vallée de Chamonix-Mt.Blanc, 74310, France.

Insurance

It is a condition of booking that all Clients have adequate medical cover and travel/Holiday insurance for the duration of their Holiday/rental period including cover for any activities/sports/winter sports that Clients may participate in. By agreeing to our Terms and Conditions in making a booking the Client is undertaking to ensure that all members of the party have such cover.

Booking Conditions

Bookings are confirmed on receipt of the deposits/full payment by CL who will issue a written confirmation of reservation to the Client. Clients should carefully check the details on the confirmation of reservation upon receipt as it may not be possible to make changes at a later date.

All Bookings are made directly with CL by telephone, email or by post. No other agent is authorised to deal with or accept bookings or payments for holidays during this period.

Deposits and Holiday balance payments

A non-refundable deposit, amounting to 35% of the Holiday price plus pre-payments for any pre-booked ancillary services within the resort, is payable immediately to confirm a booking. The balance of the holiday/rental period payment is due 10 weeks before the holiday/rental period start date. Immediate full payment may be requested for some peak season periods (Xmas,New Year,Half-Term, Easter, Mid July to Mid August). Bookings made within 10 weeks of the holiday/rental start date must be paid in full at time of booking.

If payments are not made in full on time CL reserves the right to cancel the Holiday and levy cancellation charges in accordance with these Terms and Conditions.

Cancellation

Should the client have to cancel the booking the client should immediately notify CL of the cancellation in writing as soon as possible. Cancellation will come into effect the day that written notice is received by CL and cancellation charges will be levied as followed:

* The client will be liable in full for any charges incurred by CL in cancelling pre-paid pre-ordered services

CL does not operate any scheme of cancellation insurance and the Client should obtain their own insurance cover for the holiday

CL reserves the right to cancel a booking where the Client has failed to make balance payments by the due date as on the confirmation invoice and this without notice to the Client who will forfeit deposit and any ancillary service prepayments.

Under no circumstances shall Clients be allowed access to properties where the holiday/rental period payment has not been made in full prior to the holiday/rental period start date.

CL reserves the right to cancel your booking at any time in the event of circumstances which are beyond the reasonable control of CL or if in the reasonable opinion of CL it is necessary to undertake essential works at the property in which case a comparable Holiday or a full refund will be offered. CL will not be liable for any refund/compensation in respect of cancellations, curtailment or alterations to bookings/holidays made due to circumstances including, but not limited to, force majeure; war, terrorist activities or threat of, fire, adverse weather conditions, avalanche or high avalanche risk, lack of snow, riots, strikes, airport closure, actions of third parties or other events beyond the control of CL.

Amendments

CL reserves the right to alter holiday arrangements as necessary. An amendment made prior to the holiday/rental period start date which is deemed by CL to be significant will be notified to the Client who will be offered a comparable holiday where possible or a full refund. This does not apply to changes due to circumstances beyond the reasonable control of CL.

CL will not be liable for any refund/compensation in respect of cancellations, curtailment or alterations to bookings/holidays made due to circumstances including, but not limited to, force majeure such as natural disasters, war, terrorist activities or threat of, fire, adverse weather conditions, avalanche or high avalanche risk,lack of snow, riots, strikes, airport closure, actions of third parties or similar events beyond the control of CL.

Clients wishing to make amendments to a confirmed reservation should notify CL in writing of the requested changes. Where it is reasonably possible to accommodate these requests every effort will be made to do so and in all cases the Client agrees to indemnify CL for any reasonable expense incurred in effecting any requested amendment whether or not CL is successful in meeting the requested change.

Subject to availability, any change of dates by the client within the same season and more than 70 days before the Holiday/rental period start date will be accepted without charge. Alterations of dates within 70 days of the start of the holiday/rental period will constitute a complete holiday cancellation.

Travel

All holidays/rental periods with CL exclude travel. It is the responsibility of the Client to make travel arrangements. CL accepts no responsibility for Clients travel arrangements.

Travel Documentation

It is the responsibility of the Client to ensure that all party members are in possession of valid travel documentation (passport/visas where applicable, health cover/travel/sports insurance). CL accepts no liability for loss/inconvenience/ cost incurred as a result of the Client’s lack of care in this respect.

Client Responsibility

The Client must not use the accommodation for any other purpose than that of a holiday. The number of people staying in the property should not exceed the number stated as staying on the written confirmation of reservation. The Client undertakes on behalf of the party to behave with propriety and not to behave in such a way as to cause any harm, danger, distress, damage, injury, nuisance or annoyance to CL, its reputation, neighbours, other residents or Clients, representatives, any other 3rd party or the property or any property therein. In the case of a breach of this clause CL reserves the right to terminate the Client’s contract immediately without compensation or any further contractual obligation.

No refunds will be made and CL will not be liable for covering any expenses or costs incurred as a result of the termination.

CL reserves the right to take a deposit of up to £1000 against damage (including but not limited to cigarette burns, spilled drinks, misuse of electrical appliances), loss, breakage (accidental or otherwise), extra services, hand-back cleaning. CL reserves the right to claim back from the Client the cost of any repairs/replacements/extra services requested/extra cleaning necessary. Full payment for these must be made before the Client's departure at the Holiday/rental period end. CL reserves the right to apply claims via the Client’s credit card.

CL Responsibility

It is the responsibility of CL to provide the Client with the Holiday as described on this website except where the failure to perform or the improper performance was due to the acts or omissions of the Client or of a third party not involved with the provision of the Holiday or due to circumstances which were unforeseeable or unavoidable even where CL exercised all due care.

Refunds

No refunds will be made for meals that have not been taken (catered/B&B holidays) or where beds/bedrooms have not been slept in (catered/B&B or Under-occupancy in exclusive use of chalet/whole chalet bookings - self-cater/catered holidays)

Prices

Prices quoted on the site are in Euros €. CL reserves the right to alter prices listed at any time before the Client's Holiday is booked and confirmed. Once the Holiday/rental price is a confirmed booking CL guarantees that the price will not change unless the booking is amended. CL reserves the right to decrease the listed prices of unsold holidays/rental periods for promotional purposes and to correct price errors.

Tourist tax

Local Tourist Tax is not included in the holiday prices shown on the website and is payable directly in the resort 1€/person/night

Duration of Holiday/Rental Periods

CL Self-catering/Catered/Bed and Breakfast accommodation is available from 17h00 on the rental period start date to 10h00 on the rental period end date as these dates appear on the confirmation of booking.

Special Requests

The Client should let CL know of any special requests at the time of booking. CL cannot guarantee to meet all special requests though they will do their best to do so and failure to do so will not constitute a breach of contract on the part of CL. Special dietary requirements (Bed and Breakfast/Catered Holidays) and requests for baby equipment should be made known at the time of booking.

Smoking Policy

CL operates a No Smoking Policy inside the Property

Security

Owing to the nature of chalet holidays the bedrooms may not be individually lockable and entrance to the property may be shared with the owner or staff for certain types of holidays

Descriptions

CL has endeavoured to ensure that all general descriptions contained in the website and any CL literature is accurate at the time of publication. Images contained within are intended to give a general impression only and photographs of CL property may show items of furniture/upholstery/equipment that has since been changed or removed from the property.
